Copyright Policy

This Intellectual Property Policy sets out the procedure by which owners of copyright, or their authorised representatives, may notify Kisskh (the “Operator”) of material on https://www.kisskhweb.org (the “Site”) that they believe infringes their rights, and the procedure the Operator follows on receiving such a notification. The procedure follows the Digital Millennium Copyright Act of the United States (“DMCA”) and is applied to equivalent notices under the laws of other countries.
A. Nature of the Site
The Operator does not host video content. The Site catalogues dramas, films, and television programmes and displays video through players embedded from third-party platforms, which store and transmit the files. Accordingly, the Operator’s response to a valid notification is to remove or disable the relevant player, link, or page on the Site. The underlying file remains on the host’s servers unless the host removes it.
B. Who May Submit a Notification
A notification may be submitted only by the owner of the copyright concerned or by a person authorised to act on the owner’s behalf. Before submitting a notification, you should satisfy yourself that the use complained of is not permitted by licence or by law, including any exception for fair use or fair dealing.
C. Contents of a Notification
A notification must be made in writing and must contain:
- the physical or electronic signature of the person submitting it;
- a description of the copyrighted work alleged to be infringed, or a representative list where several works are concerned;
- the precise URL of each page on the Site on which the allegedly infringing material appears;
- the name, postal address, telephone number, and email address of the person submitting it;
- a statement that the person submitting it has a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law;
- a statement that the information in the notification is accurate and, under penalty of perjury, that the person submitting it is the owner or is authorised to act on the owner’s behalf.
D. Delivery
Notifications should be sent by email to support@kisskhweb.org. Please include the words “Copyright Notification” in the subject line so that your message is routed correctly.
E. Action Taken by the Operator
The Operator will consider each notification that substantially satisfies Part C and, where it considers it appropriate, will expeditiously remove or disable access to the material identified, including links contained in visitor comments. The Operator may contact the person submitting the notification for clarification, and may provide a copy of the notification to the person who supplied the material or to the relevant host. A notification that does not substantially satisfy Part C may be disregarded.
F. Counter-Notifications
The material on the Site is, in almost all cases, published by the Operator itself, so counter-notifications are seldom relevant. Any person whose material has been removed following a notification and who believes that the removal was the result of mistake or misidentification may nevertheless submit a counter-notification to support@kisskhweb.org containing:
- that person’s physical or electronic signature;
- identification of the material removed and of the location at which it appeared;
- a statement, under penalty of perjury, of a good-faith belief that the material was removed as a result of mistake or misidentification;
- that person’s name, address, and telephone number, together with a statement consenting to the jurisdiction of the United States federal district court for the district in which that address is located (or, for an address outside the United States, any judicial district in which the Operator may be found) and agreeing to accept service of process from the person who submitted the notification.
The Operator will send a copy of a valid counter-notification to the person who submitted the notification and may restore the material not less than ten (10) and not more than fourteen (14) business days after receiving it, unless it is first informed that a court action has been filed to restrain the alleged infringement.
G. Repeat Infringement
The Operator will, in appropriate circumstances, restrict or terminate the ability of any person who repeatedly infringes copyright to use the Site, including the ability to post comments.
H. False Statements
A person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages under 17 U.S.C. § 512(f), including costs and legal fees. Equivalent liability may arise under the laws of other countries.
I. Notifications Under Other Laws
The Operator accepts notifications from rights holders worldwide. A notification made under the law of a country other than the United States will be considered if it contains information equivalent to that required by Part C.
J. Removal at the Source
To have a video file removed from the internet, rights holders should also contact the platform on which it is hosted. The Operator has no ability to remove files from third-party servers and does not answer for the procedures or decisions of those platforms.
K. Other Intellectual Property Concerns
Concerns relating to trademarks or to other rights may be sent to support@kisskhweb.org with a description of the right asserted, the material concerned, and its location on the Site.
L. Amendments
The Operator may amend this Policy at any time by publishing a revised version on the Site. The revised Policy takes effect on publication.
