Please read these Terms of Use carefully before using https://www.kisskhweb.org. They set out the terms on which Kisskh makes the website available to you, and they apply to every visit.

1. Definitions and Interpretation

In these Terms of Use:

  • “Operator,” “we,” “us,” and “our” refer to Kisskh;
  • “Site” means the website located at https://www.kisskhweb.org, including all of its pages, features, and content;
  • “Third-Party Content” means video, images, text, advertising, and any other material supplied by persons other than the Operator, including material displayed through embedded players;
  • “Video Host” means any third-party platform whose video player is embedded on the Site;
  • “you” and “your” refer to any person who accesses or uses the Site.

Words importing the singular include the plural and vice versa. The words “including” and “include” are to be read without limitation.

2. Agreement to These Terms

By accessing or using the Site, you accept these Terms of Use and agree to comply with them, together with our Privacy Policy and Copyright Policy, which are incorporated by reference. If you do not accept these Terms, you must stop using the Site immediately.

3. Description of the Site

The Site is a catalogue of dramas, films, and television programmes, providing information about titles and episodes and presenting video through players embedded from Video Hosts. The Operator does not host, upload, or store video files. The availability, quality, and legality of video delivered by Video Hosts are outside the Operator’s control.

4. Age Requirement

The Site is intended for persons aged 13 years or older, or such greater age as is required by the law of your jurisdiction. If you do not meet this requirement, you must not use the Site. By using the Site, you confirm that you meet it and that you are legally able to accept these Terms.

5. Permitted Use

The Operator grants you a revocable, non-exclusive, non-transferable licence to view the Site for your personal, non-commercial use. You may print or download extracts of pages for your own reference, provided that you do not modify them and that you retain any notices they contain. Any other use requires the Operator’s prior written consent.

6. Prohibited Conduct

You must not:

  1. use the Site in any way that breaches any applicable local, national, or international law or regulation;
  2. use the Site for any fraudulent purpose or in connection with any criminal offence;
  3. reproduce, duplicate, copy, sell, or re-sell any part of the Site in breach of these Terms;
  4. access, collect, or copy the Site or its data by automated means, including bots, spiders, and scrapers, except for search engines indexing the Site in accordance with its robots.txt file;
  5. attempt to gain unauthorised access to the Site, the server on which it is stored, or any server, computer, or database connected to it;
  6. attack the Site through a denial-of-service attack or a distributed denial-of-service attack;
  7. knowingly transmit any data or material that contains viruses, Trojan horses, worms, or other harmful code;
  8. impersonate the Operator or any other person, or falsely represent an affiliation with any person.

A breach of this clause may constitute a criminal offence. The Operator may report any such breach to the relevant law enforcement authorities and co-operate with them.

7. Visitor Contributions

Where you post a comment on the Site, the comment must be accurate where it states facts, genuinely held where it states opinions, and compliant with applicable law. It must not be defamatory, obscene, offensive, hateful, or inflammatory; must not promote violence or discrimination; must not infringe any intellectual property or privacy right; and must not contain advertising, spam, or links to unlawful material. You grant the Operator a perpetual, worldwide, non-exclusive, royalty-free licence to use, reproduce, display, and distribute your comment in connection with the Site. The Operator may remove or decline to publish any comment at its discretion.

Any suggestion, request, or feedback you send to the Operator may be used by the Operator freely and without compensation to you.

8. Third-Party Content and Services

Third-Party Content is the sole responsibility of the person who supplied it. The Operator does not review, endorse, or guarantee Third-Party Content and accepts no liability for it. Your use of any embedded player is also subject to the terms and policies of the relevant Video Host.

Video Hosts may display advertisements within their players. Such advertisements are supplied by the Video Host and not by the Operator, which does not endorse them and is not responsible for them. You should not download software or enter personal details in response to advertisements or pop-up windows displayed by a player.

Links to other websites are provided for your information only. The Operator has no control over the contents of those websites and accepts no responsibility for them or for any loss or damage arising from your use of them.

9. Ownership of the Site

The Operator owns, or is the licensee of, all intellectual property rights in the Site and in the material published on it, other than Third-Party Content. Those works are protected by copyright laws and treaties around the world, and all such rights are reserved. Trademarks, posters, and titles of individual works belong to their respective owners.

10. Infringement Notices

If you consider that any material accessible through the Site infringes your copyright, you may notify the Operator at support@kisskhweb.org in accordance with the Copyright Policy. The Operator will review each valid notice and take the action it considers appropriate, which may include removing or disabling access to the material.

11. Personal Information

The Operator processes information about you in accordance with its Privacy Policy. By using the Site, you acknowledge that processing.

12. No Warranties

The Site is provided free of charge, on an “as is” and “as available” basis. To the extent permitted by law, the Operator excludes all conditions, warranties, representations, and other terms that might otherwise be implied, including as to satisfactory quality, fitness for a particular purpose, and the use of reasonable care and skill. The Operator does not guarantee that the Site, or any content on it, will always be available, uninterrupted, accurate, or free of viruses.

13. Exclusion and Limitation of Liability

To the extent permitted by law, the Operator shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss or damage arising under or in connection with your use of, or inability to use, the Site or any Third-Party Content, including loss of profits, revenue, data, or goodwill, and any indirect or consequential loss. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law.

14. Indemnity

You shall indemnify the Operator against all losses, liabilities, costs, and expenses, including reasonable legal fees, arising from any breach of these Terms by you, from any comment you post, or from any claim that your use of the Site infringes the rights of a third party.

15. Access Restrictions and Termination

The Operator may withdraw, restrict, or suspend all or part of the Site, or your access to it, at any time and without notice, including where it reasonably believes that you have breached these Terms. Clauses 9 and 12 to 18 survive any such suspension or termination.

16. Variation

The Operator may revise these Terms at any time by amending this page. The revised Terms take effect on publication, as shown by the “Last Updated” date. Please check this page periodically, as you are bound by the version in force each time you use the Site.

17. Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of the jurisdiction in which the Operator is established, and the courts of that jurisdiction have exclusive jurisdiction. If you are a consumer, you retain the benefit of any mandatory provisions of the law of your country of residence.

18. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed and the remainder shall continue in effect. A failure or delay by the Operator in exercising any right shall not operate as a waiver of it. These Terms, together with the documents referred to in them, constitute the whole agreement between you and the Operator concerning the Site. You may not transfer your rights or obligations under these Terms; the Operator may transfer its rights and obligations to another organisation. No person other than you and the Operator has any right to enforce these Terms. The Operator is not responsible for any failure or delay caused by events outside its reasonable control.
